Murder suspects held in Estes Fire danger T1 Floodplain from Page 7 A fire that burns through a a 8 on Interstate 80 near Roscoe, Neb. He had been driving a semi-truck from New York to California and was found dead in the cab of his truck with his shoes off. The Nebraska State Patrol said a 9 mm casing and two empty 12-gauge shotgun shells were found at the rest stop. Two .9 mm pistols and a 12-gauge shotgun were recovered by local police after Sunday morning's chase on Colorado 7. The three suspects arrested were Identified as Karen K.

McGaughey, 20, Arvie W. Wommack, 22, and David W. Denman, 22, all of Tyler, Tex. Estes Park Police Chief Robert Ault said he will recommend charges of armed robbery and conspiracy to commit armed robbery be filed against the three by the District Attorney's Office. Ault said Wommack and Denman entered the 7-Eleven store in Estes Park shortly after Manager Greg Bachel opened the store at 7 p.m.

Friday at the Stove Prarie School to discuss, among a long list of other things, the fire danger in the high country, he hopes forming a cooperative will be discussed in earnest. The dead wood is a valuable natural resource as firewood, pine beetle wood paneling, fence posts and other commercial wood products. He said that if a cooperative is formed by the landowners, they could rid their lands of the dead wood, lessen the fire danger and use whatever money remains to return to the community. The money left over could be used to buy logging equipment to help correct future problems, for firefighting equipment or used to buy new trees to replant in those areas hardest hit by pine beetle infestations. He said paying individuals for their wood could result in a "bookkeeping nightmare." He added that removing the dead wood and slash and stacking it does not alleviate the threat of a fire but does improve the chances that a fire could be controlled.

a.m. Sunday. According to Ault, both men were armed and demanded all the money In the store, which they were given. The amount of money has not been disclosed. The men then reportedly put Bachel in a back room and returned to the car, which was driven by McGaughey.

Bachel contacted police after the robbers left. Officers from the Estes Park Police Department and the Colorado State Patrol went out after the robbers, finally spotting them on Colorado 7 west of Lyons. They were apprehended by Jim Edinger of Estes Park and Bill Miller of the State Patrol without resistance, according to Miller. After the three guns were found, the suspects were taken to the Estes Park Police Department where they are being held. Bond on Wommack was set In county court in Estes Park this morning at $11,000 according to Ault, and at $10,000 each for Denrrmn and McGaughey.

City Manager Robert Brunton said last week Martinez was under Investigation in connection with carelessness or negligence with city property and gross neglect of duty. Martinez twice refused to take polygraph tests, once when asked by a Fort Collins Police officer, and Friday when Instructed by Brunton. Refusal to take a polygraph is grounds for dismissal according to city practice, but not written policy, according to Assistant City Atty. Lucia Liley. From Page said that the hazardous material will still burn when it is stacked, but in piles it requires more heat to burn it than when it is not stacked.

Dead pine needles should be removed from the roofs and eaves of homes and any branches that hang over the roof of the house removed. "I'm not trying to scare people out of living In the high country but there is a problem and something has to be done," he said. Landowners can either remove the slash and dead wood and stack it themselves, have it done or form a cooperative. He said that when area landowners meet at 7:30 Charles F. Willard LEND ALE, Calif.

It's "pouring salt on the wound," the woman continued, and concluded, "If you do this (approve the zoning), this is what the Socialists and the Communists do;" it's not what the U.S. Constitution allows. Her remarks were greeted with applause from the audience.

The zoning is "just one more step in taking away citizens' rights." It would be more fair, more honorable, and more realistic to wait until it is known what compensation residents will receive. "We've been told we have to do these things right away or dire things will happen to us. Dire things already happened." How about putting a time limit on the federal government, one man asked. If there is no compensation for land at pre-flood market value within 18 months, "then we'll go back in the canyon." Again there was scattered applause. Lopez said he would rather not threaten government, but he would make request for funds as the government's moral obligation.

Ray Drake, a Loveland resident who volunteered to help immediately after the flood and was put in charge of debris removal said he could "see no responsible alternative" to the restrictive zoning. "I saw the grief and the death and the destruction I'd like to limit my sympathy to these victims and no more. We do know the consequences of no adoption. That's another tragedy. There will be another flood, ladies and gentlemen," Drake continued.

The question is when it will strike. "The risks are now well understood and (we) owe the future owners of property" notice of that risk, he said. Martinez dismissed from his city job the tops of dead trees tends to spread much faster and take on aerial characteristics. If trees have been thinned and pruned and dead wood stacked or removed, the fire will burn on the ground and be easier to control, he explained. Horvat also recommends mountain land owners support their local volunteer firefighting departments with contributions and with volunteer assistance.

Landowners with roads that are not marked or not clearly marked make it that much more difficult for firefighters to find the location, he said, adding that it's in a property owner's best interest to clearly sign all roads. It also is necessary for landowners to check with the state or federal foresters or the sheriff's office when they have a fire, even when the fire apparently is under control or extinguished. Fires that appear to be out can flare up and and destroy a forest area, he said. Fire fighters can check to Insure the fire is completely out and there is no danger of it restarting, he rioted. County Atty. George Hass, while noting that he might have to do some more research, said he thought that would be considered a recreational use. Another resident asked whether she could rebuild if she could prove her home was damaged less than 50 per cent but was bulldozed down by the Corps of Engineers. Under the floodplain regulations, a home damaged less than 50 per cent can be repaired but not expanded. Hass said if she can prove the damage level, she can rebuild.

Another woman asked if she could take in overnight guests in cottages that were less than 50 per cent damaged, even though they are in the floodway. Again the answer was "yes" because her business is considered an allowable "non-conforming use" under the regulation. The answer also was positive when Hass was asked if picnic tables could be put in the floodway. The attorney said they 'are considered "residential accessory uses" and therefore acceptable under the county regulation. What if a person's home were less than 50 per cent damaged, but he wouldn't be able to repair it within a year, as required by the floodplain regulations? Hass said he should apply for an extension on that time limit.

In addition, he noted if a home is damaged by anything besides flood, the 50 per cent level does not apply and the home can be rebuilt. AMONG THE general comments of residents was The flood was an act of God, but "what you (the commissioners) are doing is certainly not an act of God" unless there is compensation.
